INITIAL ENGAGEMENT LETTER FOR RELEASE OF CANDIDATE
Thank you for choosing Elite Personnel, Inc. to assist you with your staffing needs. We are pleased to offer several types of placement options to fit your needs. You have indicated that you would like to interview an Elite Personnel candidate in order to better determine your hiring needs. The purpose of this Agreement is (i) to explain the types of placement options available and (ii) describe the terms upon which an Elite Personnel candidate will be released to you for interview purposes.
Temp-to-Hire
One of your placement options is to hire an Elite Personnel employee on a temp-to- hire basis. The essential terms of this type of placement are as follows: The candidate will work for your organization as a temporary employee for a period of 500 consecutive hours. The temp-to-hire option allows both you and the prospective employee the opportunity to test the working relationship before making a permanent commitment. After completion of the 500 hours the candidate may be hired by you as a permanent employee at no additional fee. If either party determines during the temporary period that the fit is not right, we will work with you to identify another temp-to-hire candidate for the position. There is no placement guarantee with this option.
If you would like to permanently hire a temp-to-hire candidate prior to the completion of the 500 hours, you may do so. After completing 1-249 hours with your company/organization, the temp-to-hire candidate can be hired by your company/organization for a fee of 20% of the candidate's gross annual starting salary. After completing 250 hours with your company/organization, the temp-to-hire candidate can be hired by your organization for a discounted fee of 15% of the candidate's gross annual starting salary. You agree to immediately advise Elite Personnel of the candidate's starting salary. The fees referenced in this paragraph must be paid to Elite Personnel within 10 days of receipt of an invoice. Payment must be received by Elite Personnel before the candidate is released to you. Please keep in mind that if you decide to proceed on a temp-to-hire basis, you will need to sign a separate agreement before the candidate can be released to your company/organization.
Permanent Placement
You may also select our permanent placement option and hire an Elite Personnel employee immediately without any trial period. The standard permanent placement fees are as follows and are calculated based upon the candidate's gross starting salary:
20% with a 30-day placement guarantee
25% with a 60-day placement guarantee
30% with a 90-day placement guarantee
The fees referenced in the preceding sentence must be paid within ten (10) days of receipt of an invoice. Payment must be received on or before the start date.
We will be glad to provide a replacement or refund the fee if either you or the candidate determines the placement is not the right fit within the guaranteed time. In the unlikely event that Elite Personnel is unable, after three attempts, to place a candidate under this placement option who satisfies your needs, then we reserve the right to refund your money without any further obligation. As is the case with the temp-to-hire arrangement, you will need to sign a separate agreement before the candidate can be released to your company/organization.
As we believe you can appreciate, Elite Personnel values its relationship with its candidates and spends considerable time, effort and money selecting applicants. For this reason, Elite Personnel needs your agreement (and by signing this letter, you so agree) that you will not hire a candidate on any basis for any period of time before signing the appropriate temp-to-hire or permanent placement agreement. Although we certainly anticipate no problem in this regard, please know that if you do hire a candidate on any basis for any period of time before signing a temp-to-hire or permanent placement agreement, you will be liable to Elite Personnel for 25% of the candidate's gross starting salary as well as attorneys' fees and costs incurred in collecting any monies owed to Elite Personnel regardless of whether suit is filed. You acknowledge that the amounts referenced in the preceding sentence are reasonable and appropriate for the damage which Elite Personnel would incur. Also, if any other fees due to Elite Personnel are not paid in a timely manner, then you agree to be liable to us for attorneys' fees and costs incurred in collecting monies owed to Elite Personnel, regardless of whether suit is filed. This Agreement shall be interpreted in accordance with the laws of the State of Maryland.

Please acknowledge your consent by completing the information below and returning the fully executed Agreement to Elite Personnel. Once we have received the fully executed Agreement, we will release the candidate to you.
